1. Who we are
NAX Marathon (the "Event") is organised by NAX, a brand of THEBRG Enterprise (003120480-W), a business registered in Malaysia ("NAX", "we", "us", "our"). Contact: legal@naxmarathon.com. Partnership enquiries: marketing@naxmarathon.com.
2. Event information is provisional
The Event is announced as "Coming Soon 2027". Date, time, venue, route, categories, pricing, entitlements, cut-off times and all other details are to be confirmed and may change at any time without liability to us. Information on this website is provided for general information only and does not constitute an offer or a binding commitment until registration officially opens and your entry is confirmed in writing by us.
3. Eligibility and registration
- Participants must meet the minimum age and any qualifying criteria published for their category. Participants under 18 require written parent or guardian consent.
- You must provide accurate, complete and current information. We may reject, cancel or amend any entry containing false, incomplete or fraudulent information.
- Entries are personal. Bibs, entries and entitlements are non-transferable and non-exchangeable unless we expressly permit a transfer window.
- Registration is confirmed only when full payment is received and a confirmation email is issued.
4. Payments
All payments made on this website are processed by HitPay Payment Solutions, our third-party payment gateway. We do not collect, process or store your full card or banking credentials — these are handled entirely by HitPay and its acquiring partners under their own terms and privacy policy.
- All fees are quoted in Malaysian Ringgit (MYR) unless stated otherwise.
- Prices may exclude payment gateway charges, processing fees and applicable taxes, which are displayed before you confirm payment.
- You are responsible for any bank, currency conversion or cross-border charges imposed by your card issuer.
- If a payment is reversed, charged back or fails after confirmation, we may cancel the related entry.
5. Refunds, cancellation and postponement
- All registration fees are strictly non-refundable and non-deferrable once paid, except where required by Malaysian law or where we state otherwise in writing for a specific edition.
- If the Event is postponed, relocated or converted (in whole or in part) to a virtual format for reasons including force majeure, adverse weather, haze, epidemic or pandemic, government or authority directive, public safety, or the loss of permits or venue, your entry may be moved to the rescheduled or replacement event at our discretion. No cash refund is payable.
- If the Event is cancelled outright, any refund will be limited to a portion of the registration fee net of non-recoverable costs already incurred (including gateway charges, production, insurance and merchandise), determined at our reasonable discretion.
- Duplicate or accidental payments are refunded on written request to legal@naxmarathon.com within 14 days of the transaction, subject to verification.
6. Virtual Run
Virtual Run categories (Half Marathon 21.1KM and Full Marathon 42.2KM) may be completed at a location of your choosing within the published submission window. You must submit valid GPS or tracker evidence of the full distance in the required format. We may reject any submission that appears altered, incomplete, implausible or non-compliant, and such rejection does not entitle you to a refund. You are solely responsible for choosing a safe route, complying with traffic and local laws, and for your own safety while running.
7. Health, assumption of risk and waiver
Running is a strenuous activity carrying inherent risks, including physical injury, illness, permanent disability and death. By registering you confirm that you are medically fit to participate, have sought medical advice where appropriate, and voluntarily assume all such risks.
To the fullest extent permitted by law, you release and hold harmless NAX, THEBRG Enterprise (003120480-W), its directors, employees, agents, sponsors, partners, contractors and volunteers from any claim, demand, loss, injury, death, damage or expense arising out of or in connection with your participation, whether or not caused by negligence, save for liability that cannot be excluded by law. You consent to receiving emergency medical treatment at your own cost.
8. Rules and conduct
Participants must follow the official race rules, route markings, cut-off times, safety briefings and instructions of marshals and officials. We may disqualify or remove any participant for course-cutting, bib swapping, doping, abusive or unsafe behaviour, or any act that endangers others or brings the Event into disrepute, without refund.
9. Media and image rights
By participating you grant us a perpetual, worldwide, royalty-free licence to capture and use photographs, video and audio recordings of you taken at the Event for promotional, editorial and archival purposes across any media, without further compensation.
10. Intellectual property
The NAX name, logo, marks, site design, copy, imagery and video on this website are owned by or licensed to THEBRG Enterprise (003120480-W) and may not be copied, reproduced, modified or used commercially without our prior written consent.
11. Third-party services and links
This website may link to or rely on third-party services (including HitPay, timing providers, mapping and analytics). We are not responsible for the content, availability or practices of those third parties.
12. Limitation of liability
To the maximum extent permitted by Malaysian law, our total aggregate liability to you for any claim arising out of or relating to the Event, this website or these Terms shall not exceed the registration fee actually paid by you. We are not liable for indirect, incidental, special or consequential loss, loss of profit, travel, accommodation or opportunity costs.
13. Personal data
We process personal data in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia).
14. Changes to these Terms
We may update these Terms at any time. The version published on this website at the time of your registration or use applies. Continued use of the website constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of Malaysia. You submit to the exclusive jurisdiction of the courts of Malaysia. If any provision is held unenforceable, the remaining provisions continue in full force.
