1. Who we are

NAX Marathon (the "Event") is organised by NAX, a brand of THEBRG Enterprise (003120480-W), a business registered in Malaysia ("NAX", "we", "us", "our"). Contact: legal@naxmarathon.com. Partnership enquiries: marketing@naxmarathon.com.

2. Event information is provisional

The 1st edition of NAX Marathon is a Virtual Marathon Run scheduled for January 2027. Date, time, categories, registration fees, entitlements, cut-off times, delivery arrangements and all other details are to be confirmed and may change at any time without liability to us. Registration fees are currently stated as TBC. Information on this website is provided for general information only and does not constitute an offer or a binding commitment until registration officially opens and your entry is confirmed in writing by us.

3. Eligibility and registration

• Entry is open to participants in Malaysia only, with a valid Malaysian delivery address for race kit and finisher pack fulfilment.
• Participants must meet the minimum age and any qualifying criteria published for their category. Participants under 18 require written parent or guardian consent.
• You must provide accurate, complete and current information. We may reject, cancel or amend any entry containing false, incomplete or fraudulent information.
• Entries are personal. Bibs, entries and entitlements are non-transferable and non-exchangeable unless we expressly permit a transfer window.
• Registration is confirmed only when full payment is received and a confirmation email is issued.

4. Payments

All payments made on this website are processed by HitPay Payment Solutions, our third-party payment gateway. We do not collect, process or store your full card or banking credentials — these are handled entirely by HitPay and its acquiring partners under their own terms and privacy policy.

• All fees are quoted in Malaysian Ringgit (MYR) unless stated otherwise.
• Prices may exclude payment gateway charges, processing fees and applicable taxes, which are displayed before you confirm payment.
• You are responsible for any bank, currency conversion or cross-border charges imposed by your card issuer.
• If a payment is reversed, charged back or fails after confirmation, we may cancel the related entry.

5. Refunds, cancellation and postponement

• All registration fees are strictly non-refundable and non-deferrable once paid, except where required by Malaysian law or where we state otherwise in writing for a specific edition.
• If the Event is postponed, relocated or converted (in whole or in part) to a virtual format for reasons including force majeure, adverse weather, haze, epidemic or pandemic, government or authority directive, public safety, or the loss of permits or venue, your entry may be moved to the rescheduled or replacement event at our discretion. No cash refund is payable.
• If the Event is cancelled outright, any refund will be limited to a portion of the registration fee net of non-recoverable costs already incurred (including gateway charges, production, insurance and merchandise), determined at our reasonable discretion.
• Duplicate or accidental payments are refunded on written request to legal@naxmarathon.com within 14 days of the transaction, subject to verification.

6. Virtual Marathon Run

The 2027 edition is a Virtual Marathon Run. All six categories — 10KM, Half Marathon 21.1KM, Full Marathon 42.2KM, 84.4KM Ultra, 168.8KM Double Ultra and 337.6KM Quad Ultra — are completed at a location and time of your choosing within your registered batch window.

• Batches. 1st Batch runs 1–31 January 2027 and 2nd Batch runs 1–28 February 2027, open 24 hours a day. Evidence must be submitted within 7 days of the end of your batch. Late submissions are not accepted and are not refundable.
• Accumulated distance. Your distance does not have to be completed in a single continuous activity. Multiple runs recorded within your batch window may be added together to reach your registered total.
• Proof of completion. You must submit clear GPS or tracker evidence — screenshots showing the date, time, distance and duration of each activity — in the required format. Only activities recorded after your registration is confirmed are valid; runs completed before registration will not be counted.
• Verification. We may reject any submission that appears altered, duplicated, incomplete, implausible or otherwise non-compliant, and may request the raw activity file. Rejection does not entitle you to a refund and may lead to disqualification from the ranking.
• Your safety. You are solely responsible for choosing a safe route, complying with traffic and local laws, being medically fit for your chosen distance, and for your own safety while running. Ultra distances (84.4KM and above) carry heightened risk and are undertaken entirely at your own risk.

6.1 Category rules at a glance

Every category below is virtual, accumulative and completed within your registered batch window (1st Batch: 1–31 January 2027 · 2nd Batch: 1–28 February 2027, 24 hours a day). Evidence must be submitted within 7 days of the end of your batch. Only activities recorded after your registration is confirmed count. This table is explanatory; where it conflicts with the clauses above, the clauses prevail.

7. Territory, delivery and shipping

• The 2027 edition is open to participants in Malaysia only. You must supply a valid delivery address within Malaysia at registration. Entries submitted with an address outside Malaysia may be cancelled without refund.
• Race kits, race packs and finisher packs are delivered by our appointed logistics partner throughout West and East Malaysia, including Sabah, Sarawak and Labuan.
• Shipping fees may apply depending on your delivery location. Remote, rural, island and East Malaysia addresses may attract a surcharge and longer transit times. Any applicable charge is displayed before you confirm payment.
• Delivery timelines are estimates only. We are not liable for delays, loss or damage caused by the logistics partner, incorrect or incomplete addresses supplied by you, failed delivery attempts, customs or courier restrictions, or force majeure.
• Where a parcel is returned to us as undeliverable, re-delivery is at your cost. Unclaimed items may be disposed of after 60 days without refund.
• Report a missing, damaged or incorrect item to hello@naxmarathon.com within 7 days of the recorded delivery date, with photographs. Claims made after that period may not be accepted.
• Finisher packs are dispatched only after your submission has been verified. Sizes, colours and pack contents are subject to availability and may be substituted with an item of equivalent value.

8. Health, assumption of risk and waiver

Running is a strenuous activity carrying inherent risks, including physical injury, illness, permanent disability and death. By registering you confirm that you are medically fit to participate, have sought medical advice where appropriate, and voluntarily assume all such risks.

To the fullest extent permitted by law, you release and hold harmless NAX, THEBRG Enterprise (003120480-W), its directors, employees, agents, sponsors, partners, contractors and volunteers from any claim, demand, loss, injury, death, damage or expense arising out of or in connection with your participation, whether or not caused by negligence, save for liability that cannot be excluded by law. You consent to receiving emergency medical treatment at your own cost.

9. Rules and conduct

Participants must follow the official race rules, route markings, cut-off times, safety briefings and instructions of marshals and officials. We may disqualify or remove any participant for course-cutting, bib swapping, doping, abusive or unsafe behaviour, or any act that endangers others or brings the Event into disrepute, without refund.

10. Media and image rights

By participating you grant us a perpetual, worldwide, royalty-free licence to capture and use photographs, video and audio recordings of you taken at the Event for promotional, editorial and archival purposes across any media, without further compensation.

11. Intellectual property

The NAX name, logo, marks, site design, copy, imagery and video on this website are owned by or licensed to THEBRG Enterprise (003120480-W) and may not be copied, reproduced, modified or used commercially without our prior written consent.

12. Third-party services and links

This website may link to or rely on third-party services (including HitPay, timing providers, mapping and analytics). We are not responsible for the content, availability or practices of those third parties.

13. Limitation of liability

To the maximum extent permitted by Malaysian law, our total aggregate liability to you for any claim arising out of or relating to the Event, this website or these Terms shall not exceed the registration fee actually paid by you. We are not liable for indirect, incidental, special or consequential loss, loss of profit, travel, accommodation or opportunity costs.

14. Personal data

We process personal data in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia).

15. Changes to these Terms

We may update these Terms at any time. The version published on this website at the time of your registration or use applies. Continued use of the website constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of Malaysia. You submit to the exclusive jurisdiction of the courts of Malaysia. If any provision is held unenforceable, the remaining provisions continue in full force.
